Albert Nisbett, 47, of East Gate Lane, was also banned from driving for three years and given a six-month sentence for driving while impaired by Puisne Judge Norma Wade-Miller. Both prison sentences will run concurrently.

Nisbett was driving his car on North Shore Road near Shelly Bay Park in May, 1995 when the accident, in which Antonio DeFrais, 30, was killed, happened.

Before being sentenced Nisbett apologised to the family of the dead man.

"I would just like to express my sorrow to the family and also to my family and co-workers,'' he said.

After sentence had been passed, Mr. DeFrais' family -- his mother, brother and two sisters, hugged each other and wept openly.

But outside the courthouse they claimed that justice had not been done.

"It wasn't enough,'' Mr. DeFrais' brother Carlos said.

"I have no remorse for him whatsoever. He should have got at least ten years for what he did.'' COURTS CTS
