Around the Bermuda Courts
The man who allegedly attacked and robbed an American couple as they walked along South Road in Southampton two weeks ago appeared in court yesterday.
As the matter is indictable, Paul Smith, 35, from Scenic Heights Drive, Southampton, was not required to enter a plea on the charge that he used personal violence to rob a tourist on the night of November 26.
Bail was refused and Smith was remanded in custody until his next court appearance on December 28.
A Smith's man who was so intoxicated that he slammed into a wall was fined $1,000 and lost his licence for a year in Magistrates' Court yesterday.
Carlos Carreira, of Douglas Drive, pleaded guilty to driving while under the influence.
Crown counsel Shakira Dill told the court that a motorist called the Police after driving behind Carreira on the night of September 20 in Devonshire.
She said the motorist saw Carreira, who was on a motorcycle, swerve dangerously across the road and almost hit a wall as he approached Parsons Lane.
But Carreira lost control of his motorcycle and hit a different wall with such force that he was flung over the handlebars and smashed his face up against the concrete.
She told the court that he left the scene before Police arrived, but they caught up with him at King Edward VII Memorial Hospital where he was being treated for the laceration to his head and arrested him.
Ms Dill said tests showed that he had 151 mg of alcohol per 100 ml of blood ? almost double the legal limit.
A 36-year-old Southampton man appeared briefly in Magistrates' Court yesterday on charges of sexual exploitation involving a minor.
The man, who cannot be named for legal reasons, pleaded not guilty to three charges of touching a minor between June 26 and October 5.
He was released on $10,000 bail with one surety and will return to court on December 28.
A 55-year-old Pembroke resident, well-known by locals as a car washer in Hamilton, appeared in Magistrates' Court yesterday on charges of possession of a cannabis twist.
Adrian Looby, of King Street, pleaded guilty to the charge. He was a passenger in a car which was stopped by Police in Pembroke in August.
Crown counsel Shakira Dill told the court that Police noticed Looby was clenching something in his hand.
When asked to show what he was holding, Looby showed them the twist which was later found to contain 6.06 grammes of cannabis.
He was fined $800 and was given two weeks to pay the fine.
Senior Magistrate Archibald Warner voiced his displeasure after a man who was arrested six months ago and released on Police bail re-appeared in Magistrates' Court yesterday on charges of possession with intent to supply.
"It's unacceptable that someone is arrested for possession with intent to supply and allowed to run around for eight months on bail. It doesn't make sense to me."
Mr. Warner was referring to 29-year-old Clinton Kevin Smith of Random Lane, Warwick who was arrested on July 8 for importing cocaine and possession of cocaine with intent to supply.
Smith, who pleaded not guilty, will return to court on March 7 for trial and was released on $5,000 bail with one surety.
