The 33-year-old admitted trespassing at the old Banana Beach guest apartments on South Shore Road in Warwick.
Prosecuting, Sgt. Rex Osborne said that on the morning of June 2 Police went to Banana Beach where they found Johnston on the top floor of one of the old apartments making himself a sandwich.
When Police approached him, he said, "If you arrest me, I'll be back.'' Johnston had been arrested just three days earlier for trespassing on the same property, Sgt. Osborne said.
Johnston told Magistrate the Wor. Cheryl-Ann Mapp he had no place to live.
"Where do you expect me to live -- in the trees?'' he asked.
Mrs. Mapp, before fining him, suggested he try the Salvation Army shelter.
