Daniels tried to kill me, says Policeman

A Police officer yesterday recounted events when a man allegedly tried to kill him.

DC Warren Bundy took the stand as the first witness in the trial of Allan William Daniels in Supreme Court.

The defendant, 27, of Brooklyn Lane, Pembroke, has pleaded not guilty to using a firearm to resist arrest, possession of a firearm without a licence and possession of ammunition without a licence on February 12, 2004.

Carrington Mahoney represents the Crown and John Perry QC represents the defendant along with Charles Richardson.

The trial opened before the nine-man, three-woman jury with DC Bundy describing his version of events early that morning.

DC Bundy told the court he was on patrol in an unmarked Police car with DC Antoine Fox and DC Allan Miguel at the junction of Dundonald and Court Streets when they saw Daniels with three other men, one on a bike, exchanging something.

As soon as they approached, the man on the bike rode off and Daniels ran towards Spinning Wheel on Court Street.

The witness told the jury he chased the defendant into an alley where he tried to open a locked gate. DC Bundy told the court as he turned Daniels around to search him, he looked down and saw a gun pointing at his abdomen.

He said he saw the back piece move three times and heard three snaps, but the gun did not go off.

The officer said he was afraid so he put his hand on the barrel of the gun so it wouldn't go off and tried to pull it out of Daniels hand, the court heard.

DC Bundy said Daniels wouldn't let go of the gun and DC Miguel got involved in the struggle to get the gun from the defendant.

He alleged Daniels yelled: "Get these f*****g cops off of me", and a small crowd gathered.

At this time, DC Fox joined the struggle and all four men fell to the ground. DC Miguel grabbed the gun while Daniels laid on the ground face down with his hands tucked underneath him, the court heard.

DC Bundy said when he pulled Daniels up, he saw the magazine lying on the ground. He handcuffed Daniels, removed four bullets from the magazine and arrested him for possession of a firearm.

Daniels was taken to the Hamilton Police Station where he was searched by DC Bundy who found in his outer jacket pocket $210 in Bermudian currency, a clear plastic twist containing a white rock-like substance and seven brown paper twists.

He said he placed the drugs and money in evidence bags and signed them.

During cross-examination, Mr. Perry told DC Bundy he didn't accept his version and suggested he had not told the truth to which DC Bundy disagreed.

He also suggested his client never ran away from the officers, never had a gun in his hand and didn't try to kill DC Bundy.

Mr. Perry also questioned why DC Bundy only arrested Daniels for possession of a firearm and not for attempted murder. He suggested it was because that never happened.

DC Bundy said: "Allan Daniels tried to kill me and he knows it. He pulled that trigger several times".

The trial continues today.
