Report ordered in sex assault case The trial of a man accused of a serious sexual assault was delayed yesterday for a psychiatric report to determine

The 26-year-old Devonshire man appeared at Supreme Court charged with assaulting the woman on June 16, 1998.

But before the jury could be sworn-in, his lawyer Mark Pettingill asked for a psychiatric report because he had told him that morning that he was unable to give him instructions.

Mr. Pettingill said he was asking for the report because "counsel is concerned about the ability of its client to give proper and full instructions with regard to the trial and also the capacity to fully comprehend and understand the proceedings and the nature of the charges as they are put against him''.

Mr. Pettingill apologised to the court and Puisne Judge Norma Wade-Miller, but said the question had only arisen that morning.

Crown counsel Patrick Doherty did not oppose the application for a report.

Mrs. Justice Wade-Miller said: "If the defendant is unable to give instructions and there is some concern that he is unable to understand the proceedings, there should be a psychiatric report, then we'll empanel the jury to decide his fitness.'' The man was remanded into custody until March 1 when he will return to court to learn of the judge's decision.

The male complainant said he was making his last delivery just before 11 p.m.

to a Malva Lane, Sandys residence when the robbery occurred.

His recollection of events were cloudy, recalling only that as he proceeded along Broome Street, he realised that his bike had fallen on him and he was experiencing some pain in his back.

On further checking, he discovered an envelope containing his pizza money was missing.

The 24-year-old continued to make his delivery to the Sandys residence, before returning to the pizza store and relating his story.

HIS CO-WORKER STOLE PAY CHEQUE, BIKE CRM His co-worker stole pay cheque, bike Police are investigating the report of a stolen pay cheque and bike said to have occurred on Friday.

The male complainant said he gave his pay cheque to a co-worker to cash for him on Friday morning at around 9.30.

Because he had no transportation, he also loaned him his bike (a red Honda Scoopy AN792).

The worker, however, never returned, and could not be located at this residence.

The matter was reported to the Police.

East End Police are investigating the incident TEENS FINED FOR DANGEROUS DRIVING CTS Teens fined for dangerous driving Two teenagers were fined after they pleaded guilty to driving in a dangerous manner on December 3 and 12.

The teens were fined $300 and $200 respectively for the offences, with one of them being granted a discount because Senior Magistrate Will Francis questioned whether the charge was really one of driving without due care, a lesser charge.

Tallent J. Clark, 16, pleaded guilty in Magistrates' Court to speeding behind a Fire Service vehicle as it travelled through the Crow Lane, Paget area at 1.08 a.m. on December 12.

Crown counsel Charmaine Smith said Police watched as the truck sped through the highway followed by Clark directly behind. Clark denied this. Cervio Cox pleaded guilty to riding in a manner dangerous at 11.50 p.m. on December 3 on South Road, Paget, and Tee Street. Police saw Cox as two cycles went by at high speed near the junction of South Road and Paget Tribe Road Number One.
