Rider jailed for lashing out a police officer

A St George’s man has been jailed for 30 days after he admitting he kicked a police officer trying to arrest him.Prince Smith, 30, pleaded guilty in Magistrates’ Court to assaulting an officer causing actual bodily harm, violently resisting arrest, damaging an officer’s uniform and driving while over the legal blood-alcohol limit.Crown counsel Maria Sofianos told the court officers saw Smith driving west at high speed along Kindley Field around 10.58pm on May 19.The officers activated their emergency lights and sirens but Smith refused to stop and made a U-turn with the police in pursuit.The chase continued into St David’s, ending only when Smith attempted to cut in front of the police car.He struck the bumper and fell to the ground.The officers attempted to arrest him but he lashed out, kicking a female officer in the pelvis, causing her to yell out in pain.Smith continued to struggle. The officers attempted to use Captor spray but it had no noticeable effect.They eventually handcuffed him and took him to Hamilton Police Station.Once there, Smith agreed to give officers a sample of breath, which revealed he had 173mg of alcohol in 100ml of blood more than double the legal limit of 80mg.Smith’s lawyer Charles Richardson said his client had a clean record but had marital problems and self-medicated with alcohol on the day in question.He said Smith was violent after falling from his cycle because he was under the impression police knocked him off his bike.“That belief, coupled with alcohol, caused him to react,” Mr Richardson said.He described the incident as completely out of character, noting his lack of previous convictions.Smith apologised profusely after being placed in the police car, he added.Senior Magistrate Archibald Warner said Smith’s refusal to pull over caused the situation to escalate.“This was a malicious assault on police while they were trying to do their job,” Mr Warner said. “In all circumstances, it’s my view that this offence at least calls for an immediate custodial sentence.”He sentenced Smith to 30 days’ imprisonment for assaulting the officer and ten days’ imprisonment for violently resisting arrest.Both sentences are to run concurrently with time spent in custody taken into account.Mr Warner fined Smith $50 for wilful damage and $1,000 for driving while over the legal blood-alcohol limit and banned him from driving all vehicles for one year.
