A “Cinderella” gunman who was convicted for a gang shooting after leaving his shoe at the crime scene will be eligible for parole two-and-a-half years sooner than orginally intended following a Court of Appeals judgement.

Anwar Muhammad, 24, had been ordered to spend 12-and-a-half years of his 25-year sentence for the attempted murder of Princeton Burrows.

During his trial, the jury had heard Muhammad was the pillion passenger on a motorcycle who opened fire on Mr Burrows outside the Maximart store in Sandys on August 23, 2010. A black sneaker with Muhammad’s DNA was later found at the scene by police.

Muhammad subsequently launched appeals against both his conviction and his sentence.

In a judgement released this afternoon, the Court upheld his conviction but found that the sentencing judge had erred when setting the minimum period Muhammad must serve before being eligible for parole.

According to the Criminal Code, in cases where the sentence is greater than two years in prison, the minimum sentence should be half of the full sentence or ten years, whichever is less. As a result, the court reduced Muhammad’s minimum sentence from 12-and-a-half years to ten years.
