A 30-year-old man will spend Christmas in prison after he admitted performing a sexual act on another man in public.Kevin Mendonca pleaded guilty in Magistrates’ Court to behaving in an indecent manner in a public place, namely Front Street.The court heard that between 7.30pm and 7.45pm on September 7, officers watching CCTV cameras noticed Mendonca speaking with another man near Hamilton’s Number Six Car Park.After a short while, the two men began touching each other’s groins. They then moved to a nearby bench, where Mendonca was seen putting his head in the second man’s groin area.Prosecutors said that it was still daylight at the time of the incident, and members of the public were seen to be walking in the area.Police were alerted of the offence and arrested both men. While Mendonca initially told police that he was just talking to a friend, he later admitted that he was performing a sexual act on the man.Appearing in court, Mendonca apologised for the incident, saying that he is currently residing at a treatment centre to deal with an alcohol problem.Senior Magistrate Archibald Warner said: “This is an offence which shows blatant disregard for the decency of people around you, regardless of your lifestyle or sexuality.“I don’t think it would be any less offensive if the indecency was with a female. I’m talking about the sexual act in public, which should be discouraged.”Mr Warner said given the nature of the offence, he did not believe a community based sentence was suitable, instead sentencing Mendonca to ten days in prison.The second man was also scheduled to appear in court, but failed to do so. As a result, Mr Warner issued a warrant for his arrest.
