Gareth Finighan, 32, of Tribe Road 3, Southampton, admitted in Magistrates' Court to the offence which took place on Middle Road, Warwick last month.

Prosecutor Sgt. Phil Taylor said Police officers on mobile patrol around 10.45 p.m. on November 20 saw Finighan riding an auxiliary cycle east, near Christ Church.

The officers followed him and noticed him swerving across the centre line.

Finighan was pulled over at the corner of Cobbs Hill Road and taken to the Hamilton Police Station where a breath test revealed him to have 190 milligrams of alcohol in 100 millilitres of blood -- the legal limit is 80 milligrams.

Lawyer Juliana Jack yesterday asked the court to be lenient as Finighan's job required him to be available "at the drop of a hat''.

"Mr. Finighan moved to Bermuda one month before this incident occurred,'' Ms Jack explained. "He did not cause any injury to himself or anybody else, nor did he cause an accident. He is very sorry.'' Magistrate Arthur Hodgson fined Finighan $450 and banned him from riding auxiliary cycles for 12 months.
