Drug trial aborted

Alvin Francois and Trevor Morain were remanded in custody pending a new trial that will start after the next case on the court schedule finishes.

The duo's trial was set to begin on May 6 but the newly-selected jury was sent away while Crown Counsel Wilhelm Bourne and defence lawyer Archie Warner were involved in legal arguments before Puisne Judge Norma Wade.

Yesterday they returned to the court to hear that they were being discharged as a panel member had made previous arrangements to travel and the trial would be unlikely to finish by then following the delay.

So Mrs. Justice Wade discharged the entire jury, who had not heard any evidence, and asked them to return on May 21.

Morain and Francois have pleaded not guilty to conspiring to import cannabis between May 31 and June 19, importing cannabis between June 16 and 19, possession of cannabis intended for supply on June 18 and handling cannabis intended for supply on June 18.

They were charged with being concerned together, and with a third man, who was not before the court yesterday.

The trial due to start on May 21 involves Ellsworth Eugene Wilson who is charged with possession of diamorphine intended for supply and handling diamorphine intended for supply.

Wilson, of Mount Hill, Pembroke, is represented by lawyer Kim Wilson and has pleaded not guilty to both charges. He has been released on bail.
