Lawyers try to stop trial

against Pembroke resident Ellsworth Wilson, charged with possession and handling diamorphine with intention to supply, will proceed.

The latest twist in the on-again, off-again trial follows a morning of legal arguments in the Supreme Court. The defence team of John Perry QC, Tim Marshall and Kim Wilson yesterday asked Mrs. Justice Wade to stay the proceedings on the grounds that to continue prosecution would constitute a further abuse of process.

The submission comes on the heels of an internal Police investigation which last week concluded there was insufficient evidence to back allegations some narcotics officers had attempted to pervert the course of justice.

It was alleged at the opening of Wilson's trial in late May that narcotics officers had attempted to persuade a colleague to commit perjury.

Once the allegation surfaced, the Crown immediately asked for an adjournment "in the interests of justice''.

A team of officers, under Deputy Commissioner Jean Jacques Lemay, was appointed to determine the validity of the allegations; their findings were released to the media on Friday afternoon.

Should Mrs. Justice Wade rule for the Crown a 12-member jury will be empanelled and the trial will proceed.

Attorney General Elliott Mottley and Wilhelm Bourne are representing the Crown.
