Trott `trespassing at resort'

Roberta Trott was present in Magistrates Court yesterday as a trial date was set for the proceedings, arising out of an incident at Cambridges Beaches following her husband's death.
Lawyer Georgia Marshall said her client had a warrant outstanding after an administrative hiccup led to her non-appearance in court, following confusion after a change of lawyers.
"This matter fell through the cracks,'' said Mrs. Marshall.
Mrs. Trott, who is currently fighting a legal battle to remain in the home she shared with her husband at Cambridge Beaches, was arrested at a resort swimming pool.
The incident came in August 1998, after she had received a notice, telling her not to trespass on land other than All Spice cottage, its grounds and access.
Subsequently, she attended court and entered a plea of not guilty.
Mrs. Marshall told Magistrate Archibald Warner that issues relating to the alleged trespass were being argued in a civil matter currently before Puisne Judge Norma Wade Miller.
And she added that, depending on the outcome of the civil matter, the summary charge may not be an issue in the future.
A trial date was set for April 4.
The civil case involves plaintiffs Cambridge Beaches and landowners Frascati Hotel Co., and Mrs. Trott.
The plaintiffs say the widow has no right to remain in the cottage and want possession.
They are also claiming $224,856 in damages, which they say could have been reaped from letting All Spice to guests.
But Mrs. Trott argued that there was an agreement for a five year lease to be drawn up for the property, to commence one year after the death of Mr. Trott.
