Centre Re employee fined $500 for attack on woman
yesterday for assaulting a woman and causing her grievous bodily harm.
David Cash, of Old South Road, Southampton, was charged with assaulting Jean Ann Forde on December 23 in Southampton.
Magistrate Edward King yesterday found him guilty of the charge which stemmed from a problem with the water pressure at the condominium complex where Cash and Ms Forde lived.
In the evidence at the trial earlier this year, Ms Forde said she answered a knocking at the door of her condominium and found Cash there.
He asked her if she was aware of a water problem at the condos and she said no and closed the door.
Ms Forde said Cash returned 15 minutes later and asked if her father was home as he had helped him fix a similar water problem previously. She replied that her father was overseas and told him to contact his landlord.
As she went to close the door, Cash grabbed it, prompting a tug-of-war between himself and Ms Forde. She became terrified and after managing to close her door, felt a sharp pain in her shoulder.
She called her doctor who arrived a short time later and diagnosed her shoulder pain as the result of a dislocation of the joint.
Meanwhile Cash told the court that he arrived home on December 23 to find no water pressure. He had to bathe his young child so he went to Ms Forde's home in the hope of getting her father to help him fix the problem as he had done in the past.
He said Ms Forde was unpleasant towards him and when he realised she did not want to speak to him, he let go of the door which he had been holding open.
Mr. King rejected Cash's testimony as untruthful and found Ms Forde's testimony as truthful. He fined Cash $500 after noting that he had no previous convictions.
