Woman sobs as she tells court how man sexually assaulted her

A man with a history of violence against women yesterday began serving a three-year prison sentence.

Kevin Eugene Daniels, 34, of South Breakers Road, Smith's Parish was convicted in Magistrates' Court of sexually assaulting a Sandys Parish woman in broad daylight at Par-La-Ville car park on August 21.

Daniels, who worked at St. Brendan's Hospital, had denied the charge.

But his victim yesterday sobbed as she recalled the incident.

She told the court after she finished work on August 21 she went to the car park.

After letting her car "air out'', the woman said she climbed in and noticed a man coming up the steps from the park.

The woman said she was listening to music while waiting for her sister when "there was a noise and something hit my car''.

She said she saw a broom on the back of her car and "noticed the man I had seen earlier was behind the trees which were behind my car''.

After getting out of the car, removing the broom, and climbing back in, the woman said she saw Daniels throw a stick at the side of her car.

"I shouted what are you doing and tried to start my car,'' she recalled.

"The man rushed to the side of the car.'' And, she added, Daniels began shouting: "What am I doing?''.

She said she tried to start the car but Daniels was halfway in the driver's side window.

Pausing to compose herself, the woman said: "He grabbed the centre of my skirt and proceeded to rip it. And by doing this he grabbed my crotch and my skirt ripped.'' She said she struggled and screamed which caused Daniels to move away.

She said she then got out of the car and ran toward the steps leading to the park as Daniels shouted, "You want some more?'' She added that Daniels picked up the broom and threw it at her.

The woman said she got back in the car and drove off after Daniels moved away.

She said she then found her sister and they both went to Hamilton Police Station where the incident was reported.

The woman later identified Daniels in a Police identification line-up at Prospect.

Det. Con. Terrence Maxwell said Daniels, in Police statements, admitted he was in Par-La-Ville Park around 5 p.m. on August 21.

He said Daniels also admitted to touching the woman on her leg without her permission.

But Det. Con. Maxwell said Daniels claimed that the woman ripped her skirt as she moved away from him.

Daniels also denied squeezing the woman's thighs, Det. Con Maxwell added.

Daniels yesterday initially denied making and signing any Police statements.

He said Police tried to coerce statements out of him.

He also said on the evening in question he was at home doing yardwork.

Daniels also denied he was convicted on September 28, 1992 of unlawfully and indecently assaulting a woman.

He added that he had never been convicted of an offence.

But after Magistrate the Wor. Edward King explained the meaning of the word "conviction'', Daniels admitted that he spent nine months in prison for touching the breast of the victim in the 1992 incident.

And after Mr. King explained purgery, Daniels admitted signing the Police statements.

Mr. King told Daniels he had "proven to be an absolutely untruthful witness''.

"He has done nothing but try to show the Police as conniving fabricators of the truth,'' Mr. King said.

Before sentencing Daniels to three years in prison, Mr. King heard that Daniels had more than 25 convictions -- mainly for acts of violence or sexual aggression toward females -- in last 15 years.

Daniels, who was on probation for 18 months for trying to steal a lady's handbag, also received a three-month prison sentence for breaching his probation.

The sentences are to run concurrently with time Daniels has already served to be taken into consideration.

Mr. King also recommended that Daniels receive psychiatric treatment while in prison.
