Man on early release admits drugs charges

Senior Magistrate Will Francis heard that Shayne McRoy Smith had been on licence release last year when he was caught on two separate occasions with drugs.

Smith, 34, formerly of Town Hill Road, Smith's Parish, pleaded guilty to four charges of possessing cocaine, diamorphine (heroin), and cannabis.

Police saw Smith standing with a group of men at Curving Avenue, Pembroke on October 15 last year, Police prosecutor Sgt. Philip Taylor told the court.

The officers saw Smith reach into his shirt and throw a container to the ground.

Police seized the container and arrested Smith on suspicion of violating the Misuse of Drugs Act.

Sgt. Taylor said Smith told Police: "You're only doing this because I shot Beckles (a Police officer).'' At Hamilton Police Station, Smith gave a voluntary statement in which he denied possession of the container.

The container was later found to contain a brown paper twist with .43 grams of cannabis and two more paper twists containing eight foil wraps of diamorphine, weighing a total of .022 grams.

Sgt. Taylor said at 12.30 p.m. on November 8 Smith was stopped near John Smith's Bay in Smith's Parish as he walked in the direction of Summerhaven.

As officers approached him, Smith put his hands in his pockets.

When he was asked to remove his hands, officers noted he was holding a small white bag which was found to contain plant material and a rock-like substance.

The contents were later analysed and found to contain .17 grams of cannabis and .12 grams of cocaine which was 84 percent pure.

Duty counsel Kim Wilson told Mr. Francis: "He has tried to demonstrate his remorse and ensure that upon his release in 2001 he will be able to be productive.'' She said he had taken a small business class, a navigation course, and voluntarily entered the Hazelton drug treatment programme.

Ms Wilson asked that any sentence be made concurrent to the sentence for which Smith had been recalled back to Westgate Correctional Facility.

Mr. Francis ordered Smith to pay $150 or serve ten days in default for possessing diamorphine on October 15, and $200 or 15 days in default for having cannabis on that day.

Smith must also pay $150 or serve 10 days in default for possessing cocaine on November 8.

He was further fined $200 or ordered to serve 15 days for possessing cannabis on that date.

The sentences are to run concurrent to the 14-year prison term.

Smith was convicted in 1986 for shooting then P.c. Harold Beckles and another man and firing at a third man.

He was sentenced to ten years in prison which was increased to 14 years upon appeal.

Recently, Smith received a suspended prison sentence for an undisclosed offence and was recalled back to prison.
