Tucker conviction upheld

Mr. Thomas, 59, suffered bruising to his chest and cheek area as well as cuts to his left temple after being punched about by Tucker of Broken Hill, Smith's Parish.

The trial was heard by magistrate Cheryl Ann Mapp who convicted Tucker, then 20, of grievous bodily harm after accepting Mr. Thomas' version of what happened to be true.

Last year, Puisne Judge Vincent Meerabux overturned the lower court ruling, holding that the magistrate had not followed proper procedure in explaining which facts she held to be true and which false.

But yesterday the judges from the Court of Appeals ruled that her arguments were clear and restored the conviction. Tucker is expected to be sentenced in Magistrates' Court in due course.
