Tio Tavaun Smith is jointly charged along with Gerald Green for causing grievous bodily harm to another person in 1994.

Smith, 22, of Scenic Heights Road, told Senior Magistrate Will Francis that his co-accused had left the Island.

"I would like to get this over without Mr. Green because he's not going to come,'' he said.

Mr. Francis ordered Smith to return for mention on May 27.
