A Sandys man was sentenced to a week in jail after kicking a police officer at Somerset Police Station.Senior Magistrate Archibald Warner found Edward Simons, 28, guilty of one count of using threatening words and one count of assault, but found him not guilty of a second charge of using threatening words.Magistrates’ Court heard yesterday that officers were called to Arnolds Market in Somerset after reports of a trespasser on the property.Pc Ralshon Douglas, responding to the call, said that when he arrived on scene Simons was speaking with Gary Johnston, a store manager, in the parking lot outside the store.Pc Douglas told the court he heard Simons tell Mr Johnston; “I have got my eye on you,” while pointing his finger menacingly at the manager.Warned by Pc Douglas not to use threatening words, Simons responded: “F*** you, I got my eye on the white boy.”Pc Douglas arrested Simons and took him to the Somerset Police Station to be processed.While being processed in the station’s jail area, Pc Douglas said Simons sprang up from his seat and kicked the officer in his chest saying: “I’m a crack you, if you are lucky. I’m a crack you.“I know your face. I’m going to speak to Paula Cox about you.”However Simons denied the offences, saying he was never taken to the Somerset Police Station and called the officer a liar.Making his judgement, Mr Warner said that the words allegedly said to Mr Johnston, making up the first of the two threatening words charges, did not reach the level of threatening words and found Simons not guilty of that offence.But Mr Warner found Simons guilty of threatening and kicking Pc Douglas, sentencing him to seven days imprisonment for both offence, with time spent in custody taken into account.
