Road Safety Council to discuss toddler accident
The Road Safety Council has placed an accident which saw a three year old have to undergo major surgery at the top of its agenda at its next meeting later this month.
Government Road Safety Officer Roxanne Christopher yesterday said she still knew very little about the accident which occurred at Shelly Bay Park on August 22.
Toddler Derik Dill was injured while playing in the park during daylight.
"I am hearing various stories from family members of baby Derik and it is difficult for me to make a comment at this time,'' Ms. Christopher said. "I will have to wait until Police have completed their report.'' The August 22 accident saw cab driver Eugene Bean collide with the infant girl in a section of Shelly Bay Park which is restricted to emergency vehicles.
Police who attended the scene had informed the child's family that no further action could be taken with the driver as the accident had taken place on private property.
But Police later said the area could be construed as part of public thoroughway and have launched a full investigation.
The recent accident highlights the need for clarity in a number of areas, including if road accidents can only be considered so if they take place on public property, and what will take place if a similar accident takes place on private grounds.
Ms. Christopher agreed that these questions needed answers but stressed she could not respond until given legal advice and until the Council had met to "hammer out the issues''.
"I have gotten a copy of the Act and do think the Police should have had jurisdiction, but I cannot give a definitive answer yet,'' she said. "We are trying to get clarity and are working out where the lines will be drawn for Police. But we will have to take legal advice and hear from Police. I do agree that both the Police and the public need to know this information.''
