Alleged rape victim breaks down during court trial

The woman, now 20-years-old, claimed she was raped by the 23-year-old man at Whale Bay beach in Southampton in September, 1992.

Describing the events she claimed took place on the beach, she began crying and was unable to continue her testimony.

Earlier, the woman said she had known the defendant for over two years and met him through his sister at a baby shower.

"I attended the shower with my boyfriend. We sat around and talked and then we left,'' the woman said. "We went back to my house where we ate dinner, talked and watched television. Then he left at about 10.30 p.m.

"At about 11 p.m. the phone rang and I answered it. A girl told me to hold on and then I heard a man's voice making strange noises on the phone. I was about to hang up but the man said don't hang up and then he identified himself.

"We talked for a while and he said he knew my boyfriend. He then asked me if he could come over the next day. I told him no. He then asked if he could come that night but I told him that it was too late. Then he told me he was coming over.'' The woman added that when he arrived, she sat in the front seat of the car and he got in and drove off. "He drove to Whale Bay beach and got out of the car.

He started walking towards the beach. I followed him because I didn't want to stay in the dark parking lot.'' "When we got to the beach, we were talking and then he kissed me. I pulled away and told him that I already had a boyfriend.

"He then said something about old time's sake and started to walk off. I walked towards the car and he walked towards the rocks.'' The complainant said that soon after she met up with the defendant again. "He flopped me on the ground and I started crying. He was holding my hands above my head by my wrists. I couldn't move my arms.

"I started screaming and he told me to shut up. I stopped screaming.'' The complainant said her legs were closed and he pushed them apart. "I was on my back. I told him that my period was on.'' Earlier, the godmother's daughter and cousin of the teenager took the stand.

She said she had known the defendant and he had visited the complainant at their home.

She said that on the day in question, she was at home with her family. "The phone rang. She told me that a friend wanted to speak to her,'' the cousin said.

"After that I fell asleep, I didn't see her leave. At 1.15 a.m she woke me up and said she wanted to talk to me outside. She was very quiet and withdrawn.

She was also crying and distressed.

"I went in and spoke to my mother who had woken up because she heard crying.'' The cousin added that she asked her mother whether she could borrow her bike to take the woman to the Police.

"My mother asked me what for and I didn't know if I should tell her.'' The defendant's lawyer Mr. Phil Perinchief asked if she had any reason to believe the story given by the woman wasn't true. The cousin said: "I believe it was true and that is why I told my mother.'' Mr. Perinchief added: "I think you were reluctant to tell your mother because you weren't convinced of the story.'' The trial continues.
