George Rushe, who prosecuted the criminal case against Colin Simmons privately in Magistrates' Court, told The Royal Gazette yesterday he had filed notice of appeal.

Simmons, of Tribe Road 3 in Pembroke, the treasurer of the Bermuda Industrial Union, was recently found not guilty of assault, violently interfering with political liberty, behaving in a threatening manner, and using threatening behaviour at a public meeting.

All the offences were allegedly committed on Rushe, a part-time journalist who was a BIU member at the time.

Senior Magistrate the Wor. Will Francis ruled that Rushe knew he had no business attending a special BIU meeting at the union headquarters on July 2, and Simmons used reasonable force in ejecting him.
