Indecency case put off
his trial was due to start.
The 52-year-old man, who is charged with committing an indecent act on June 7 in Hamilton, was to go on trial for the matter on Monday.
Crown counsel Leighton Rochester was ready to call witnesses when Darrell asked Senior Magistrate Will Francis for "three days'' to enable him to get a lawyer.
Mr. Francis asked the man, who has been at Westgate Correctional Facility on remand since July 17, if he understood that adjourning his case would mean it might not get heard for a while.
"If I don't try it today the trial won't get on until February. You don't want to be in remand until then do you?'' Mr. Francis asked.
He then inquired as to why he did not work on getting a lawyer during his time on remand.
The accused said he was never given an opportunity to make a phone call to his mother and sister who he said could contact lawyer Michael Scott.
"You're now asking for this case to be adjourned until you can get a lawyer?'' Mr. Francis asked.
Mr. Francis told the man he would adjourn the case for six days for mention.
"If no lawyer comes with you next Monday, I will not hear any more applications for a lawyer,'' he warned.
The case will be mentioned in Magistrates' Court on October 13.
