Bermuda continued yesterday, but was adjourned until later this month.

The trial of Heather Fox, 29, started in March but has been delayed several times, and will not resume until May 21.

In the trial being heard before Acting Senior Magistrate Edward King, it was heard that Fox originally admitted taking the cash when interviewed by Police, but later denied the charges.

Det. Con. David Geraghty continued his evidence and Richard Horseman who is defending Fox, asked if he recalled a conversation in which Fox asked about contacting a lawyer.

Det. Con Geraghty said he could not remember anything along those lines.

Mr. Horseman then asked the officer if Fox had been dissuaded from contacting a lawyer.

Det. Con. Geraghty said: "That's not correct, even though I don't recall that conversation, at no time would I dissuade any person from speaking to a lawyer. In fact, for cases such as this, I'm often more comfortable speaking to a suspect with their lawyer present.'' Mr. Horseman also asked if anyone had suggested that if Fox took the money with the intent of paying it back, that technically would not be stealing.

"That was not said either by myself or in my presence,'' said Det. Con.

Geraghty.

Evidence was also heard from Ernest Lathan Philpott, a security guard of ten years at the Bank.

He told the court how he transported money to the vaults from the tellers, and said that on Monday, January 10, he was called down to the vaults by his supervisor, Mary Francis, and he put away the last cash box which belonged to Fox.

Mr. Philpott said that when he checked, all the drawers were locked, and he carried on as normal, putting the locked boxes into the vault.

He said he was called down the next morning by Ms Francis who was with Ms Fox, who said her box must have been open when it was put in the safe, a claim denied by Mr. Philpott.

Mr. Horseman also asked if Mr. Philpott was aware that Ms Fox had left early on the January 10, but he said she must have come back.

Mr. Horseman said, however, that Fox never came back that evening.

"That's a lie'' said Mr. Philpott.

When Mr. Horesman asked why Fox's box had been put in to the vault last, he said: "Because we were waiting for her to finish her work. She was the last to leave that day.''
