Chief Justice accused of prejudicing jury

The appeal relates to the conviction of Lightbourne for robbery and wounding the owner of Woody's Drive Inn in Sandys Parish back in December 1995.

Randolph's lawyer in the appeal, Mark Telemaque, took the judges through the court documents, pointing out where he contended the Chief Justice failed.

Letting the appellant's previous conviction to be put to the jury, allowing hearsay evidence to be admitted and neglecting to use any evidence that supported Lightbourne, while making his summation to the jury, were the main problems Mr. Telemaque listed.

He also argued that Mr. Justice Ward erred in his direction to the jury on the right of his client to silence. And he further took issue with the way some of the summation was worded, charging that it painted his client as guilty.

The judges, however, pointed out to Mr. Telemaque that allowing evidence of Lightbourne's previous conviction seemed necessary as it addressed "a vital, vital issue in the case'' and cleared up "aspersions cast against the Police'' which had arisen during the trial.

They determined that they did not need to hear Mr. Telemaque's arguments refuted by the Crown. Their ruling is expected soon.
