Woodmont Nursery school stopped construction on its two new classrooms after the Corporation of Hamilton filed an injunction application, aimed to bar any further work on the site.

If the injunction -- which is to be heard on Friday -- is successful, then work will come to a standstill until an appeal by the Corporation is heard in November.

The dispute is over space between the property and roadside, which the Corporation believes would be further encroached upon if the classrooms were permitted.

An appeal against the approval of planning permission by the Environment Minister was dismissed by the Supreme Court in April, but the Corporation decided to take the matter further.

Corporation Secretary Roger Sherratt said the application had been filed yesterday.
