Avery, 18, had pleaded guilty in Magistrates' Court earlier this year to driving at 64 km on December 14 last year.
Police had said at the time that 12 minutes before Avery was stopped there was an accident on the corner of Washington and Park Roads -- but that was not where Avery had reported an accident occurring.
Avery said he did report the accident to Police but they never went to check it out.
He argued he decided to speed to the Hamilton Police Station to report the accident because it was close by.
Mr. Justice Ward said he should have called for an ambulance instead. An upset Avery told a reporter afterwards: "If you ever see an accident or robbery don't tell anybody. You might just get a speeding ticket.''
