h124 Govt. appeals decision in cruelty case
not to deprive a Pembroke man of one of three horses which were seized from him while under his care.
Government veterinarian Dr. Neil Burnie filed the writ last week and it is understood it will soon be in the hands of the Attorney General.
Nigel Rawn Tucker was fined $750 after he admitted to starving and neglecting three horses that were under his care. The horses were seized by the SPCA on July 4, 1995, in an emaciated state.
Two of the horses eventually died.
Tucker pleaded guilty before Magistrate Edward King on July 17. Mr. King fined him $250 for each count and prohibited from owning horses for five years. He was also given ten days to dispose of the one surviving horse, Taji.
At the time of the sentencing the Crown petitioned Mr. King to deprive Tucker of ownership of the surviving horse immediately under Section 15 of the Care and Protection of Animals Act, but the petition was rejected.
