Top runner faces prison sentence

Cann, 25, of Warwick, was released on bail until January 27 when he will return to court for sentencing.

However, Puisne Judge the Hon. Mr. Justice Ward said he is likely headed for prison. "This offence, it seems to me ... will lead to a custodial sentence in any event,'' said Mr. Ward. "The question really is just how long.'' Cann, one of the Island's most talented road runners who once played soccer for the Somerset Trojans and Somerset Eagles, entered his guilty plea at the monthly arraignments in Supreme Court.

The offence occurred at Bermuda Airport on February 16.

A Police report included with court documents said four packages of cannabis were found in three pillowcases Cann carried. The amount of cannabis found was not specified.

The judge agreed to a request from lawyer Mr. Michael Scott that a social inquiry report be prepared. The report would help by outlining the history of Cann's family circumstances, he said.

Cann is married and has one son.

Mr. Ward said it was unusual for him to extend bail pending sentencing after a plea of guilty to a serious charge. "But the history of this matter has been unusual,'' he said.

While out on bail, Cann "has always showed up (for court), so an extension of three weeks for him to get his affairs in order should not prove prejudicial.'' A 36-year-old Sandys man is to be sentenced on February 2 after the Crown accepted his pleas yesterday on arson-related charges.

Malcolm Leroy Eugene Simmons has admitted attempting to set fire to a building while someone was inside it on March 31 last year. He also admitted he threw an article containing flammable liquid, with intent to damage property, on the same date.

But he denied he threw a petrol bomb at Henry James with intent to burn him on March 31. Simmons will not have to stand trial on that charge.

Lawyer Mr. Philip Perinchief asked for a social inquiry report. Simmons was remanded in custody.

A 59-year-old Pembroke man is to stand trial on January 25, charged with assault with intent to commit rape. His bail was extended.

Also at arraignments, a January 18 trial date was set for Michael Wayne Brown, 30, of King Street in Hamilton.

Brown is charged with possession of a controlled drug with intent to supply and possession of drug equipment. The offences are alleged to have occurred on October 26, 1991 in Bermuda.

Brown, who at his last appearance asked for a change of lawyers, was unrepresented by counsel yesterday. He was remanded in custody.

A 50-year-old Sandys man was remanded until February 1 on charges of rape and incest. The man was granted bail last month so he could seek medical treatment for a heart condition.

The offences are alleged to have occurred on February 15.
