proper procedures when they carried out his arrest.

Tracy Tucker, who runs the Odyssey nightspot on Front Street, was picked up by armed drugs squad officers in St. Maarten on June 30 along with three local men.

The swoop, which took place at the Townhouse Hotel in the island's capital Philipsberg, unearthed nearly four pounds of cocaine with a street value of more than $150,000. Tucker, 30, was subsequently charged with importing cocaine from Curacao to the island and remanded in custody.

But at yesterday's hearing Tucker's lawyer argued that drugs officers acted unlawfully when they made the bust. Mrs. Monier Alam produced two witnesses who said that the officers failed to show their search warrants.

Another defence witness told the court that he had heard one of Tucker's co-defendants, Caracaon Michael Breed, apologise to Tucker after their arrest for getting him involved in the raid. The defence argued that this showed that Tucker just happened to be in the wrong place at the wrong time.

But when cross examined Breed denied this, saying that he had not spoken to Tucker since the pair were incarcerated.

The case was adjourned until next Monday following a request by Mrs. Alam to gather more information.
