Puisne Judge Norma Wade-Miller made the ruling yesterday after Bukhari's lawyer, Delroy Duncan, failed in his application to have the manslaughter charge thrown out of court. Mr. Duncan claimed the indictment was invalid.

Bukhari was charged in June 1998 for the part he allegedly played in the death of Ms Cadell, a former sub-editor for The Royal Gazette .

In delivering her judgment, Mrs. Justice Wade-Miller ruled that the indictment should not be quashed, but ordered that details of the alleged crime should be delivered to the defendant. In addition, she directed that the wording on the indictment should be more specific.

Ms Cadell, from the United Kindom, was found in the couple's apartment on Harvey Hill Road in Devonshire on May 31, 1997. A post mortem examination revealed she had swallowed 150 aspirin.
