Indecent act case adjourned
Rectory last year will have to wait two weeks before the prosecution and defence sum up their cases.
The man, who denies the charge, is alleged to have taken off his clothes and touched himself in a sexual manner outside a window at the residence of the Rector of St. Peter's Church.
In earlier evidence in Magistrates' Court, Police officers said they were on surveillance at the rectory on April 6, 1995 when they observed a man walk up a driveway on Government Hill and remove all his clothes.
P.c. Diallo Sharrieff told the court he was in a shed on the property and a man about five-feet eight-inches tall with a light brown complexion came within two feet of his location.
He said he saw the man stop at the door of the rectory and take off his clothes: "I could not see his full body. Next I went to the door of the shed and I saw a naked man standing at the window. He was right next to it. He had knocked on the window with one hand and the other hand was holding his penis and he appeared to be masturbating.'' The man was eventually alerted to the Police presence and ran off across St.
George's Golf Course.
Clothing and a pair of sneakers were found near the scene and the accused was picked up for questioning the next day.
Investigating officer Det. Insp Stuart Crockwell said that the man admitted the offence to Police in a statement.
But Richard Hector, representing the accused, countered that the admission was obtained improperly because he claimed the man was told he would be charged with a more serious offence -- housebreaking -- if he did not cooperate with Police.
Insp. Crockwell acknowledged that the accused gave Police two statements, but he also denied defence claims that Police told him if he cooperated he would be released on bail.
The trial before Magistrate Cheryl Ann Mapp, with Sgt. Rex Osborne prosecuting, resumes on August 27 at 9.30 a.m.
