But Clare Hatcher, representing the alleged victim -- a former woman Police constable -- said the evidence should be open to the public.
Mr. Marshall also heard from Kieron Unwin, representing The Royal Gazette , who appealed for no reporting restrictions and free publication of the evidence.
Details of the alleged incident, dating back to 1996, have yet to be revealed in the inquiry, at St. Theresa's Cathedral Hall, Hamilton.
Eight days have been set aside for the hearing, ordered after a complaint to the Human Rights Commission.
