upheld by an industrial tribunal.

Dockworkers imposed an overtime ban after Shawn Perrott was dismissed from his job with Stevedoring Services last October.

But yesterday an industrial tribunal ruled that the company had not acted unfairly in the matter.

At the time of the dispute Mr. Perrott's uncle, Bermuda Industrial Union vice president Chris Furbert had to be removed from the premises by Police.

Stevedoring Services president Michael Lohan yesterday said: "The tribunal ruled that in severing the employment of Shawn Perrott following his refusal to undertake an assignment the employer had acted with just cause.

"The issue blew up over the weekend of October 3 when Mr. Furbert instigated industrial action through implementing an overtime ban over the firing of his nephew and had to be escorted from from the docks by Police.

"This is a landmark event for Stevedoring Services as it has now been established once and for all that they are a full essential service which means that, with any future industrial action at the docks, the BIU will have to give 21 days notice.''
