Reject speculation, jurors told

Supreme Court jurors are expected to decide the fate on Monday of a Policeman accused of sexually assaulting three young boys.

Yesterday, the seven-man five-woman jury listened to a summary of evidence presented by Assistant Justice Carlisle Greaves who told them to carefully make a decision based on evidence and not on speculation.

The trial, which has now stretched into its second week, has been closely followed by the public including members of the Bermuda Police Force and the Island's legal community.

On Thursday, lawyers gave impassioned closing arguments with defence lawyer John Perry QC claiming the officer, who denies all the charges against him, was the target of initial prejudice because of the nature of the offences.

He told the jury the officer was a kind man who gave children gifts.

Senior Crown counsel Juan Wolffe said the case was about lost innocence.

The Policeman, who cannot be named for legal reasons, was charged with a total of ten sexual offences including buggery.

The three boys were aged between ten and 11 at the time of the alleged assaults. Mr. Perry pointed out that the complaints made by the three boys were in a “narrow period” - between January and February, 2002.

However, Mr. Greaves pointed out to the jury that the complaints go as far back as 1996 and are not fixed at any specific date as the three boys were allegedly assaulted between 1996 and 2002.

He read through the evidence from witnesses given in court including testimony given by the mothers of the three boy, one who admitted having a sexual relationship with the accused.

Mr. Perry said the defendant was a man of good character, honesty and integrity because he was a Police officer and that sometimes children lied.

Last week, Mr. Wolffe told the jury the three boys met the defendant at three separate and distinct times. He asked the jury: “What are the odds of them lying about the same thing?”

One boy, now 14, tearfully told the court last week of how he was sodomised by the officer while he was staying at his home during the Christmas holidays in 2001.
