DICKINSON, Mr DProposed New One Dwelling Unit with Shed.P0072/13 Type: Final Decision: ApprovePlanner: Victoria CaroloDiscussion: The technical officer presented the application details to the Board with a recommendation of approval.The Board queried whether a building height of 24 feet was typical of other residential developments on the island. The technical officer indicated that two storey developments exist on the island and in this regard the proposed development is not out of character. Further, the technical officer confirmed that the height policy within the Bermuda Plan 2008 Planning Statement allows for a maximum height of 24 feet and that with the exception of the viewing tower element at 24.5 feet, the proposed dwelling will be 18 feet from grade to eave.The Board queried how construction vehicles and materials are brought to the site.The technical officer indicated that a golf cart vehicle with an attached trailer is used to transport construction material to the site from the dock along the existing right of ways that exist on the island and that machinery such as excavating machines are driven directly to the site along these same access ways. It was further confirmed by the technical officer that the right of ways leading from the dock to the lots on the island are not paved but are rather dirt tracks ranging in width typically between eight and 10 feet.A Board member in raising the point that given the application site comprises two separate lots, queried if the Department is charged with any aspect of the amalgamation of those lots. The technical officer confirmed that the Department does not process amalgamations and that it is a matter dealt directly by a lawyer through the action of re-describing title deeds. The Board resolved to approve the application.The Board RESOLVED:To approve the application, as received 15 March, 2013 and revised 3 May 2013 subject to the following condition(s):1. The development hereby permitted shall be begun before the expiration of 2 (two) years from the date of this permission.2. For the avoidance of doubt the consent hereby granted is for planning permission only. Prior to the commencement of building operations a separate application for a building permit must be made and approved.3. In order to ensure that the proposed development is of an appropriate scale, no part of the hereby approved building shall exceed 24.5 feet above final grade.4. In the interest of visual amenity, there shall be no deposition or storage of excavated material on site and all excess unused material shall be removed from the site during the course of building operations and prior to the issuance of a Certificate of Completion and Occupancy.5. In order to protect lands within the Agricultural Reserve and Woodland Reserve Conservation Areas, protective fencing no less than four feet in height shall be erected prior to the commencement of building operations, on the site as shown on the hereby approved drawing. All protective fencing shall be retained in place during the period of building operations but removed prior to the issuance of a Certificate of Completion and Occupancy. For the avoidance of doubt, there shall be no storage of construction materials or equipment within the Conservation Area during the course of building operations.6. In the interests of visual amenity, the entire site subject of this application shall be landscaped in accordance with the hereby approved plans, prior to the issuance of a Certificate of Completion and Occupancy. Any trees or shrubs shown on approved plans which are removed, which die or which become seriously diseased or damaged shall be replaced by trees and shrubs of similar size and species to those originally required to be planted. Similarly, any trees which are shown as being retained on approved plans and which are removed or damaged during the course of excavation or construction, shall require the submission of a revised landscaping plan, via an Application for Revision, showing details of the size, species and number of new plantings to be installed to replace any damaged or destroyed trees.7. Prior to the issuance of a Building Permit, a final plan of subdivision demonstrating that a formal easement has been created for the area of car and cycle parking located at 11 Narrows Lane, St George's and serving development at Lots 34 and 35 Smith's Island, St George's shall be submitted for the approval of the Development Applications Board. The plan must clearly show the details of the easement area including the size, location, configuration and use. Further, once the plan of subdivision has been registered, the new easement must be fully and appropriately described in revised deed information for the subject site. A letter from a lawyer so advising will be required before the Building Permit is issued.8. The existing Bermuda Palmetto trees identified for relocation on the approved plans are protected under the Protected Species Act 2003. The relocation of the trees will require a permit from the Department of Conservation Services which must be provided with the Building Permit application.9. In the interests of protecting the conservation areas on the site, only the area designated on the hereby approved plans as a staging area for materials and machinery shall be used during the course of building operations.10. The approved temporary shed shall be removed prior to the issuance of a Certificate of Completion and Occupancy.
