Prison for man who broke into home armed with stun gun, condoms

Erskine Phillips was jailed for 12 years for breaking into a female neighbour's home armed with a stun gun, masking tape, a knife and condoms.

A burglar who broke into his female neighbour's home armed with a stun gun, knife, condoms and duct tape has been jailed for 12 years.Erskine Phillips, 34, was fought off by the woman's boyfriend and ended up in hospital with serious head injuries.Victim Gina Liburd, 27, is convinced Phillips planned to sexually assault her, and says she has found it hard to sleep since the attack in the early hours of June 20 2011 (see separate interview with Ms Liburd).Prosecutor Susan Mulligan described the crime as “the most horrific nightmare for any woman” when she addressed Phillips' Supreme Court sentencing hearing yesterday.She explained the victim was asleep in bed at her Middle Town Lane, Pembroke, home at 3.40am when she awoke to find Phillips in her bedroom. He was dressed in black, wearing a ski mask and gloves, and was armed with a stun gun.Ms Liburd's screams woke her boyfriend Wayne Wales, 31, who jumped out of bed to confront Phillips, but Phillips opened fire on him with the stun gun. A violent struggle broke out and both men tumbled downstairs. Mr Wales chased Phillips out of the house, and they fell over a wall and down into an alleyway.The burglar continued trying to use the stun gun on Mr Wales, who grabbed him and forced his head into a wall several times, leaving him unconscious.Mr Wales suffered cuts and bruises in the tussle. A neighbour stepped in to help, and the police and an ambulance were called.When the burglar's mask was pulled off, Ms Liburd recognised him as her neighbour. Her passport and other personal documents were found in his pocket along with a flick knife and a packet of condoms. He had a pillowcase looped through his belt containing a roll of duct tape.Police believe Phillips got into the house through a ground floor window. Ms Liburd's sons, aged nine and 11, were in the house at the time.The burglar was arrested after hospital treatment for what the prosecutor described as “serious injuries.” Mr Wales was also arrested but released without charge after two days.Phillips pleaded guilty late last year to burgling the house, causing actual bodily harm to Mr Wales, and possessing the stun gun. Ms Mulligan told the court it could be inferred what he was planning to do that night.“His intention, had he not been stopped by Wayne Wales, was to commit a sexual assault. At the very least, he intended to cause harm to Ms Liburd,” she said.She said of the crime: “It's the most horrific nightmare for any woman who lives alone with small children or is alone at night on this island.”Phillips declined to participate in a mental health evaluation. When probation staff interviewed him, he claimed he'd had a “strained” relationship with Ms Liburd for the past 18 months and believed she was trying to “use him”. He said he wanted to intimidate and frighten her by breaking into her house, but denied he was planning a sexual assault.Puisne Judge Carlisle Greaves dismissed Phillip's explanation for the attack as “absurd”.Defence lawyer Charles Richardson maintained that no sexual assault had been planned. He said Phillips should be given credit for pleading guilty.According to Ms Mulligan, he is married and has no previous convictions. He apologised to the judge and asked for lenience, but made no mention of why he committed the crime.Sentencing him, the judge said it “boggled the mind” to try to understand why he would suddenly commit “such a terrible act”.Ms Mulligan suggested Phillips “must have a serious psychological problem or certainly a serious problem with anger and violence”. The judge said he must undergo treatment for any mental and sexual issues before he is released from jail.
