A man who failed to provide a breath sample after a traffic stop has been banned from the roads for a year.

Heys Wolfe, 33, of Southampton, pleaded guilty in Magistrates’ Court this morning to speeding and failing to comply with a request for a sample of breath on November 15.

The court heard that, at about 1.25pm that day, Police were carrying out speed checks on Middle Road in Warwick when they clocked Wolfe travelling at 59km/h.

Officers stopped Wolfe near the junction with Burnt House Hill, noticed that his breath smelled like alcohol and that he appeared unsteady on his feet.

He was subsequently arrested on suspicion of driving while impaired, at which point he asked Police: “Why are you doing this? I’m five minutes away from home.”

Wolfe agreed to provide a breath sample, but failed to do so after being taken to Hamilton Police Station. Told that it was an offence to refuse or fail to provide a breath sample, he cursed at the officer.

After pleading guilty, he told the court: “I felt a little intimidated in the situation because I wasn’t speeding. I felt a little right in the situation.”

Magistrate Khamisi Tokunbo fined Wolfe $200 for speeding and another $1,200 for failing to provide a breath sample. Wolfe was also banned from operating all vehicles for a year.
