Woman who allegedly assaulted Police given bail
A woman accused of assaulting Police and shouting racial slurs was granted bail after firing her lawyer and telling a Magistrate: “I’m an upstanding citizen.”Latoya Simons, 28, is alleged to have told female cop Chaquita Simmons: “F**k you b*tch. F**k the police and burn motherf**kers”, during an angry tirade.She’s further accused of calling male constable Oswin Pereira an “Indian motherf**ker”.The officers told Ms Simons’ trial on Wednesday she began cursing after being asked to move her car which was obstructing the road outside the Ice Queen restaurant in Paget around 3.30am on Monday.When they arrested her for using offensive words, she spat in their faces and yelled more abuse.The officers told the trial Simons continued to be violent after being handcuffed and taken to a police car, and had to be restrained with Captor spray.During the alleged assault, Pc Simmons suffered a chest injury which required hospital treatment.Defence lawyer Larry Scott suggested on Wednesday that the two officers were in plain clothes and Simons did not know they were police.He claimed she only lashed out in response to being sprayed with Captor.The officers told the court they were in uniform.Ms Simons has been in custody since her arrest. Senior Magistrate Archibald Warner remanded her after her initial court appearance on Tuesday.However, the scheduled second day of her trial did not take place yesterday after Ms Simons said she did not want Mr Scott to represent her anymore.She has a previous conviction from 2005 for swearing at police and violently resisting arrest.However, she maintains her innocence over Monday’s alleged incident where she’s charged with assault and using offensive words.Mr Scott told Mr Warner he was in a “difficult position” because he’d urged her to “take a certain course” in relation to the charges.“She doesn’t want to consider what I’m proposing,” he reported.Asking to withdraw from the case, he added: “Ms Simons has indicated that she is not happy with my representation.”Asked by Mr Warner if she continued to say she was not guilty of the charges, Ms Simons said she was.Mr Warner responded by telling her: “I do not understand what your defence is in this case in the light of the evidence so far.”Ms Simons, who works at HSBC bank, responded that she’d not had chance to properly brief Mr Scott.She told Mr Warner she wants a new attorney, and stated: “I’m an upstanding citizen. I have a job. I was wondering if you would be lenient and I could post bail today.”Mr Warner expressed concern at the idea of further delaying the outcome of the trial while she remains in custody.He told her if he does end up convicting her: “You will not be sentenced to any more than a short, sharp shock, a few days’ imprisonment.“I think the maximum is six months’ imprisonment for these summary offences so I’m going to grant you bail. It would be wrong for me to keep you in custody longer.”However, he warned: “I don’t want you to think you’re smart or clever using the system to get bail.”He gave her a week to find a new lawyer and told her she must behave herself in the interim and post $2,000 bail with one surety. Ms Simons laughed as she replied: “Yes, I will behave myself.”She laughed some more and hugged supporters after the hearing.
