Jail time for man who tried to pervert justice
A St George’s man was jailed for two years for assaulting two women and perverting the course of justice in a case involving an alleged Parkside affiliate.Darrin Burgess, 29, of Battery Close, pleaded guilty to causing grievous bodily harm to one woman on February 25. He also admitted to punching another woman on February 4 and sending her text messages promising to give her money in exchange for withholding testimony in a case involving Prince Edness.Magistrates’ Court heard one assault took place at Burgess’ friend’s house when they were drinking alcohol.An argument broke out and the friend’s sister ordered the two men outside.The fighting between the men continued and when the woman tried to intervene she was punched in the face and suffered a broken nose and facial cuts.Burgess said: “I have a drinking problem, so we were drinking or whatever, and we were making noise so she asked us to go outside.“Her boyfriend, he had stabbed me from we guys making noise in the house. As a result of him stabbing me she even said in her statement I was upset and all hyper, blood was gushing from me.“I thought they were coming to attack me and she jumped in my way as I tried to hit the brother and the boyfriend.”Burgess said the woman has since accepted his apology.In a separate incident on February 4 around midnight another woman was approached by Mr Edness at Captain’s Lounge on Reid Street, the court heard.The atmosphere in the club is said to have changed and become hostile and the woman was punched in the face by Burgess without warning.She went home and reported the matter to police. She didn’t seek any medical attention, but complained of a sore jaw and headaches.Mr Edness was arrested and detained at Hamilton Police Station and the woman reportedly received text messages from Burgess urging her to have Mr Edness released from custody.When cautioned by police on Monday, Burgess said he punched the woman because he had been drinking and thought she was a guy.Yesterday he said the woman was heavyset and had on a full face helmet and large coat, so he had mistaken her for a man.“I am telling the truth because I don’t have nothing to hide. I am trying to get my life together.”In regards to the text messages, he said: “She was getting in contact with me. I was apologising saying, ‘We do not have to go through this’. I said it for me so I can get off.”Burgess told the court he was trying to get his life on track and said: “After I thought about it. I will get all this out of the way. Maybe this is a start I can get in my life.“I have been on the street for a long time and I have tried to get my life in order but things do not work out and I just go back to the streets and stuff. But I want this to be the time I go on the straight and narrow and get my life set for my children and my family.”Senior Magistrate Archibald Warner sentenced Burgess to 12 months behind bars, followed by two years’ probation, for the February 25 assault.He sentenced him to 30 days’ imprisonment for the assault at Captain’s Lounge. He will also serve two years in prison for perverting the course of justice, in addition to two years’ probation and taking part in drug rehabilitation programmes.All sentences will be served concurrently.
