Devonshire man fined for refusing breath test after Police warned him about riding
A Devonshire man was fined after he admitted violently resisting arrest and cursing at police.Derek Weeks, 25, from Valley Heights Road, pleaded guilty in Magistrates’ Court to violently resisting arrest, using offensive words and refusing to submit to a breath test in an incident outside the Jamaican Grill in Bailey’s Bay.However he denied charges that he assaulted the officer and had care and control of a vehicle while impaired, which were both dropped.Crown counsel Nicole Smith told the court that at around 12.45am on March 31, officers responded to a report of a dispute at the restaurant.When they arrived, they found Weeks holding a woman against a wall.The officers attempted to intervene, but Weeks began to swear at the officers, shouting: “F*** off. Where you came from?”The officers noticed that Weeks smelled strongly intoxicated and warned him that using offensive language is an offence.They attempted to get Week’s name and address, but he refused to give the officers any information.Weeks stumbled towards an auxiliary cycle and the officers informed him that he was under arrest, to which he responded: “F*** off. I don’t give a f***.”The officers attempted to handcuff him but Weeks continued to struggle, cursing all the while.The group of officers were eventually able to handcuff Weeks and put him inside a police car, but he began banging his head against the glass.Later, when asked to provide a sample of breath, he responded: “I’m not blowing s***.”Appearing in Magistrates’ Court, Weeks apologised, saying that he needs to stop drinking.Magistrate Khamisi Tokunbo fined Weeks $300 for resisting arrest and another $300 for using offensive language.Regarding the charge of refusal to give a breath sample, Mr Tokunbo fined Weeks $800 and disqualified him from driving all vehicles, placing him on one years probation.
