Heroin importer’s sentencing delayed

A Supreme Court sentencing on a $1.4 million heroin case was postponed yesterday because a production order to transport the defendant from prison to court was not made.Shannon Forth, 46, admitted importing the controlled drug on December 6, 2011 during a June court appearance, but he denied possessing heroin with intent to supply.Crown counsel Maria Sofianos and defence lawyer Elizabeth Christopher were in court for the proceedings but the defendant, who is currently on remand at Westgate Correctional Facility was not.Puisne Judge Charles Etta Simmons said: “Its very obvious the defendant is not here because a production order was not made.”She added that it made “no sense” to order a warrant for Forth’s arrest for failing to show because he is already in custody on remand.Justice Simmons set the case down for Monday to follow another case in the Supreme Court for sentencing at either 11am or 3.30pm on Monday afternoon.Mr Forth, who at the time of his arrest was of no fixed abode, admitted importing 483.7 grams of diamorphine on a commercial airline flight from Canada last year.
