Man caught with cannabis gets conditional discharge
A 25-year-old man caught with 4.63 grams of cannabis, was given a conditional discharge.Anthony Smith of Spanish Heights, Pembroke, pleaded guilty in Magistrates’ Court to possession of the drug.Prosecutor Nicole Smith said officers discovered he had the drug as they searched him on Front Street in Hamilton on another matter on February 26.They found a quantity of plant-like material in Smith’s left pocket.When they asked Smith what the substance was, he replied: “You know what it is, it’s weed.”The defendant was arrested under the suspicion of possession of a controlled drug.The material was later tested and found to be 4.63 grams of cannabis.Defence lawyer Venous Memari told the court that Smith had turned his life around since the arrest.He had since completed a rehabilitation programme at Turning Point, she said.Ms Memari argued that instead of the standard conviction and fine, her client should instead receive a conditional discharge.She said that he had since started a trucking service with his father and gotten an apartment and could one day pursue a college degree or diploma in the United States.A drug conviction on his record could see Smith placed on the “infamous Stop List”, making that impossible, Ms Memari stated.Senior Magistrate Archibald Warner insisted there was no such stop list, referencing an interview with US Consul Adam Vogelzang in The Royal Gazette.Despite that, he gave Smith a 12-month conditional discharge.
