Motorists fined for using hand-held devices

Two motorists were fined in Magistrates’ Court yesterday for operating hand-held devices while driving.Leroy Brangman, 52, and Lou Matthews, 43, both pleaded guilty to the offence and received $300 fines and six demerit points each.Brangman told Senior Magistrate Archibald Warner he was driving his taxi along Front Street at five miles an hour on March 24 when he was ticketed by a police officer.He said he was simply turning up the volume on the bluetooth device in his ear but Mr Warner said the term “hand-held device” referred to the cell phone and the bluetooth earpiece.“In my view, in law, those two pieces of equipment comprise a hand-held device and you were using it,” Mr Warner said.Brangman asked for a reduced fine but the magistrate said it had already been discounted because of his guilty plea. He gave him an extension until July 30 to pay.Matthews was charged with committing the offence on March 20 but no other details of the offence were given.
