Driver fined and banned for refusing to take breath test

Refusing a breathalyser test cost a man his driver’s licence and $1,500 in fines.Derick Gibbons, 41, of St David’s, pleaded guilty to refusing a breathalyser test following a random police search on July 6 in St George’s.In Magistrates’ Court, Crown counsel Susan Mulligan explained police stopped Gibbons on St David’s Road at 11.10pm, and conducted a vehicle search. During the search the officers smelled alcohol on Gibbons’ breath and noticed his eyes were red.When asked by officers if he was drinking, Gibbons responded: “I only had one Heineken with my boss, I’m not drunk.”Gibbons was arrested on suspicion of driving while impaired.When police asked Gibbons why he refused the breathalyser test, he responded: “For what? He’s going to lock me up, I refuse because I’m not getting out.”Senior Magistrate Archibald Warner banned Gibbons from the road for 12 months and fined him $1,500.
