‘iPod motorist’ freed after fine paid

An irate motorist who chose jail upon being convicted of using a hand-held device while driving has been freed after paying the $400 fine.Duane Lindo, 50, of Lookout Lane, Devonshire told The Royal Gazette he had spent just a few hours incarcerated before his employer posted bail.Mr Lindo told Magistrates’ Court on Monday that he’d been wearing iPod headphones while riding his motorcycle on May 18 when police pulled him over — but argued that the device hadn’t been switched on.However, Senior Magistrate Archibald Warner replied that, under the law, having any such device available for use was grounds for conviction. He was ordered to pay the fine or spend 40 days in prison.
