A Hamilton Parish man will have to wait for the findings of a pathologist’s report to discover if he is to be charged with murder.

Vincent Outerbridge, 40, was convicted last November of wounding with intent to do grievous bodily harm in an attack on former Bermuda Regiment officer Stephen Bainbridge in June 2013.

Mr Bainbridge died last month at the age of 70 and prosecutors are now trying to establish if he died as a result of injuries received during the attack.

Yesterday Outerbridge, who has been in custody since last summer, was due to be sentenced for the attack, but prosecutor Karen King asked that the matter be adjourned to allow a pathologist’s report to be filed.

Puisne Judge Carlisle Greaves told Outerbridge: “The incident for which you were convicted occurred in June 2013, and he has now died so what the Crown is seeking is we need to stop and take a look and see if you may find yourself charged with a more serious offence. It may be murder or manslaughter or something like that.

“This man has died less than a year and a day since the alleged assault on him by you and if they find a connection between your actions on him and his death you may find yourself on a more serious charge.”

Outerbridge replied: “I don’t know how they can prove it.” Mr Justice Greaves explained: “People sometimes die from injuries after they look all right, so in the circumstances they are waiting for a pathologist’s report so they are asking for an adjournment until then.

“It may be that they may not be able to establish a link and so there may be no further charges. It may be that they can establish a link and there will be further charges so those are the two scenarios.”

Outerbridge was remanded into custody until next month’s arraignments session.

Mr Bainbridge, a keen photographer who served in the Regiment for several decades as an intelligence officer, was buried last Saturday.
