Trial for man accused of assaulting motorist
A Sandys man has denied attacking another man while on bail for an alleged assault that took place ten days earlier
Desai Jones, 41, denied assaulting David Burgess, throwing his cell phone into the sea and smashing his car’s wing mirror.
The offenses are alleged to have occurred on May 28 — just eight days after Mr Jones had been bailed after facing allegations of committing another assault.
According to prosecutor Nicole Smith, Mr Jones smashed Mr Burgess’ car window while overtaking him on a motorcycle in Spanish Point, Pembroke.
Mr Jones told him that “the mirror was already broken”, and refused to pay, said Ms Smith.
After exchanging words, Mr Burgess is said to have began dialling the police on his cell phone, but Mr Jones allegedly grabbed the phone out of his hand and placed it on the roof of the car.
When the police called back, Mr Burgess picked up the phone in an attempt to answer the call, but Mr Jones allegedly snatched the device from his hand and threw it into the ocean, knocking Mr Burgess’ glasses off his face in the process.
Ms Smith suggested that Mr Jones should be remanded into custody, claiming he was likely to reoffend if given bail.
But Senior Magistrate Archibald Warner pointed out that common assault usually results in a fine, and that to remand Mr Jones would exceed the punishment he would receive if found guilty.
Mr Warner ultimately released Mr Jones on $2,000 bail. He will be tried on July 20.
