Road ban for two Southampton men
A Southampton man has been banned from the roads for 18 months for driving while over the legal blood-alcohol limit.
Appearing in Magistrates’ Court this morning, Milton Ferreira, 34, pleaded guilty to the offence, which took place in Paget on June 15.
The Crown accepted his plea and offered no evidence on the alternative charge of driving while impaired.
The court heard that Ferreira was stopped by police officers after they observed his bike swerving over the centre lane on Harbour Road.
They noted that Ferreira appeared to be intoxicated and arrested him on suspicion of driving while impaired.
He was taken to Hamilton Police Station, where a breath test showed that he 236 milligrams of alcohol in 100 millilitres of blood — almost three times the legal limit of 80mg.
Magistrate Khamisi Tokunbo handed Ferreira a $1,200 fine and disqualified him from driving for 18 months.
In a separate matter, 46-year-old Jose Xavier, of Southampton, was also disqualified from driving for 18 months.
Xavier pleaded guilty to driving while over the legal blood-alcohol limit on Cobbs Hill Road in Warwick on May 3.
The Crown accepted his plea and offered no evidence on the alternative charge of driving while impaired.
Prosecutor Karen King told the court that Xavier was stopped by police officers after he failed to come to a stop at a stop sign.
While Xavier was identifying himself, the officers noted that his breath smelled of alcohol, his eyes were red and glazed, and that he appeared unsteady on his feet.
When asked if he had been drinking, Xavier replied “no”.
He was taken to Hamilton Police Station where it was determined that he had 156mg of alcohol in 100ml of blood.
Mr Tokunbo disqualified Xavier from driving all vehicles for 18 months and fined him $1,200.
