Smith’s man fined for threatening police
A 27-year-old Smith’s man has been fined $400 for threatening police officers and refusing to leave Spanish Point Boat Club.
Appearing in Magistrates’ Court on Monday, Alex Mcdonough pleaded guilty to the offences, which took place on Sunday, July 17, in Pembroke.
He denied assaulting a police officer and the Crown offered no evidence on that charge.
The court heard that police attended the club at 7.15pm in response to a report of a person refusing to leave the premises. They encountered Mcdonough, who was shirtless, shoeless and appeared intoxicated, demanding entry.
“Let me go inside so I can thump him one,” he told the officers.
As they tried to calm him down, he repeatedly threatened the officers, telling them: “I will f*** you up.”
He continued to use a “barrage of offensive words” as he was being arrested. The officers used Captor spray but it failed to calm the defendant.
In court, Mcdonough said: “Sorry, can’t remember it.”
Duty counsel Leonard Holder said the accused had left possessions in the club and was trying to retrieve them.
“That’s about as much as he remembers,” he said.
Mcdonough added: “And the pepper spray.”
Magistrate Khamisi Tokunbo handed him a $100 fine for failing to leave the club and a $300 penalty for using threatening words towards the police officers.
