Man banned from driving until 2022
A Southampton man has been banned from the road until 2022 after admitting a drink-driving charge.
Magistrates’ Court heard that Tyshaun Brown, 23, was already disqualified when the offence took place.
He was banned for three years in June after being convicted of careless driving.
The court heard that at about 3.50am on August 3, police stopped Brown while he was driving along Middle Road near Port Royal.
Officers noticed that his breath smelled of alcohol and his voice was slurred.
Asked if he had been drinking, Brown said: “Yes. I had two drinks, but I’m not drunk.”
During the conversation police also became aware that Brown had been disqualified from driving all vehicles.
Brown admitted being banned and said: “Yes, I’m off the road, but how am I supposed to get to work?”
The court heard Brown struggled with police as they arrested him, but later agreed to provide police with a breath sample, which showed a lower reading of 106mg of alcohol in 100ml of blood — more than the legal limit of 80mg.
Addressing the court, Brown apologised, saying that he began riding again because he had been attacked on a previous night and wanted to “stay on the safe side”.
He also said that another person was supposed to be giving him a ride that night, but that person left with a girl and he did not have money for a taxi.
Magistrate Khamisi Tokunbo banned Brown from driving all vehicles for another two years, consecutive to the previous disqualification — a total of five years.
He also fined Brown $1,200 for driving over the legal blood-alcohol limit and $1,000 for driving while disqualified.
